Terms of Service
Effective May 1, 2025
1. Who we are
Horme is a marketplace for developer boilerplates and starter kits, operated by Benjamin Manguet, auto-entrepreneur, SIRET 839 564 234 00038, 4, impasse des Iris, 17540 Angliers, France ("Horme", "we", or "us").
By using the website horme.dev or purchasing a product from the Horme catalog, you agree to these Terms of Service.
2. Products
Horme sells digital products — boilerplates and starter kits — in the form of source code archives. Products are created either by Horme directly or by independent third-party sellers who have been approved to list on the marketplace.
Each product page describes what is included, the technologies used, and the applicable price. We make every effort to ensure that descriptions are accurate and up to date.
3. Purchasing a product
All purchases are processed by Lemon Squeezy, who acts as Merchant of Record. This means Lemon Squeezy is the seller of record for tax and legal purposes, and your invoice will be issued by Lemon Squeezy. Payment is accepted by card and other methods offered at checkout.
Upon successful payment, you will receive an email from Lemon Squeezy containing a download link for your purchase. You can re-download your purchase at any time via the Lemon Squeezy customer portal using the link in your confirmation email.
4. License
Each purchase grants you a single commercial license to use the source code in your own projects. Specifically, you are permitted to:
- Use the code to build and launch any number of your own products or client projects.
- Modify the code freely.
- Keep a private copy for personal or team use within a single organization.
You are not permitted to:
- Resell, sublicense, or redistribute the source code itself as a standalone product.
- Share the code with individuals or organizations who have not purchased a license.
- Use the code to create a competing boilerplate marketplace.
If you need a multi-seat or team license, contact us at benjamin.manguet@gmail.com to discuss options.
5. Updates
Lifetime updates are included with every purchase. When a new version of the product is released, you will be notified by email with a new download link. Updates are provided at the seller's discretion and are not guaranteed on any specific schedule.
6. Third-party seller products
Some products on Horme are created and maintained by independent sellers. Horme reviews all products before they are listed but does not guarantee the quality, accuracy, or fitness for purpose of third-party products beyond what is described on the product page.
For third-party products, Horme collects a 5% commission on each sale. The remaining 95% is paid to the seller on a monthly basis.
Disputes regarding third-party products should be directed to Horme at benjamin.manguet@gmail.com, who will act as intermediary between the buyer and the seller.
7. Refunds
Our refund policy is described in our Refund Policy. In summary: refunds are considered on a case-by-case basis within 14 days of purchase if the product does not match its description.
Given that the products are digital goods delivered immediately upon purchase, the right of withdrawal provided for in articles L.221-18 et seq. of the French Consumer Code does not apply, provided that you have expressly consented to the commencement of performance before the expiry of the withdrawal period and acknowledged that you will thereby lose your right of withdrawal. This acknowledgment is captured during the checkout process via Lemon Squeezy.
8. Intellectual property
Each product remains the intellectual property of its creator — either Horme or the applicable third-party seller. The license granted in section 4 does not transfer ownership of the code. The Horme brand, website design, and all content on horme.dev are the exclusive property of Benjamin Manguet.
9. Limitation of liability
To the maximum extent permitted by applicable law, Horme shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of a product purchased on the marketplace. Our total liability for any claim arising from a purchase shall not exceed the amount paid for that purchase.
Horme products are provided as source code foundations. You are responsible for the production use, security auditing, and deployment of any code you build using these foundations.
10. Governing law and jurisdiction
These Terms of Service are governed by French law. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts of France, unless mandatory consumer protection laws in your country of residence provide otherwise.
11. Changes to these terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Continued use of the site after changes constitutes acceptance of the new terms.
